Carlos Felipe Llinás Negret is a Board Certified Specialist in Admiralty and Maritime Law. He has been with Lipcon, Margulies, Alsina & Winkleman, P.A. since 2009.
Mr. Llinás Negret’s practice focuses on complex commercial vessel litigation. He has represented clients in a variety of maritime matters and continues to be among the most active attorneys at the firm.
Some of Mr. Llinás Negret’s notable representations include: admiralty limitation of liability actions, admiralty power of federal courts under Article III, labor and employment Jones Act disputes, admiralty Rule B property attachments, maritime products liability, cruise ship passenger personal injury and wrongful death matters, and enforcement/vacatur of arbitral awards.
Mr. Llinás Negret is also an active appellate attorney who routinely handles claims in federal and Florida appellate courts. His most recent appellate successes include a winning opinion from the United States Court of Appeals for the Eleventh Circuit in the matter of Vasquez v. YII Shipping Company, Ltd., (11th Cir. 2012) (reversing the district court’s dismissal and holding that collateral estoppel did not bar a seaman’s claim against a shipping company under the Jones Act and federal maritime law), and a winning opinion from the Florida Third District Court of Appeal in the matter of Fitzpatrick v. Club Mediterranee, (3d DCA 2015) (holding that employee was not required to arbitrate sexual assault claims against employer, because the claims did not fall within the scope of the arbitration agreement).
Mr. Llinás Negret is a distinguished promoter of seamen’s rights. On October 1, 2012, he was featured in the international television documentary, “Dispatches, Cruises Undercover: The Truth Below Deck” on the British public-service television network, Channel 4. This documentary received worldwide attention as it exposed disparate pay and horrific work conditions for some workers in the luxury cruise line industry. On December 2014, Los Angeles Lawyer, a prestigious publication in California, published one of Mr. Llinas Negret’s articles on Seafarers’ rights under United States law.
Mr. Llinás Negret grew up in Madrid, Spain. He is fluent in Spanish and assists with bilingual representations and court dealings for the firm.
He earned his Bachelor in Business Administration degree from the University of Miami in 2005. While attending the University of Miami, Mr. Llinás Negret was profiled in President Donna Shalala’s Annual Report as one of five “students primed for greatness.”
Mr. Llinás Negret received his law degree from St. Thomas University School of Law in Miami, Florida. During law school he received a book award for the highest class grade in Professional Responsibility, and served as an instructor of Civil Procedure to first year law students.
Mr. Llinás Negret is admitted to practice law in three states. He is licensed in Florida, California, and Washington D.C. Mr. Llinás is also admitted to practice in front of the United States District Court for the Central District of California, the United States District Court for Southern District of Florida, the United States Court of Appeals for the Eleventh Circuit, the United States Court of Appeals for the First Circuit, and the Supreme Court of the United States.
