Attorney Winkleman Speaks to NBC Regarding Cruise Ship Rape and Sexual Assault

Going on a cruise ship should be a wonderful experience. Before you depart, there is so much to plan and anticipate. From the onboard activities to the offshore excursions, you may find yourself overwhelmed with the amount of possibilities that are in store. After all, cruise lines these days are well equipped with almost anything your heart could desire. So it only makes sense that you would anticipate smooth sailing.

Unfortunately, for many people, accident and injury at sea turn their idyllic cruise ship into a vacation nightmare. The reality is that cruise ship rape and sexual assault are the two most commonly reported crimes on the water. This is a striking and sad stastitic, made worse by the fact that many of the victims of these crimes are under the age of 18.

This summer, an NBC report shed light on the extent of the problem. In a two-part investigation, NBC illuminated the challenges that victims of rape and sexual assault must face in the aftermath of the attack. Many experience the frustration of following all necessary protocol on the ship, only to discover that it may be almost impossible to press charges back on land.

The FBI insists that rape and sexual assault aboard cruise ships can pose difficulties in terms of investigation, as teams may not have access to the ship, the scene of the crime or potential witnesses, until long after the event has taken place.

The Cruise Line Is No Longer Your Friend

Our own Michael Winkleman spoke with NBC. He explained, “Part of the problem is as soon as someone gets hurt, as soon as someone gets raped, as soon as something bad happens, [the cruise line is] no longer your friend, they’re not there to protect you.” The reason, he believes, lies in the cruise line’s understanding of what is to come. “Cruise lines, once you get hurt, they see you as their adversary because, chances are there’s going to be a lawsuit that comes afterwards.”

As soon as an incident is reported, the cruise line begins to take immediate steps to protect itself.  This includes gathering evidence it believes will be helpful in defeating a potential lawsuit.  Cruise lines will also monitor the actions and responses of the victim and their traveling companions following an assault which it will use against the victim if a claim is brought.   It is crucial that assistance from a source with no ties to the cruise line is sought as soon as possible help protect the victim’s interests and ensure they get the help needed.
