The family of a 21-year-old Omaha woman who was killed in a boating accident this summer is encouraged to seek legal counsel with a maritime lawyer for the tragic death. The man responsible for the boat accident was charged Tuesday for his role in the incident, and the family of the deceased victim may have grounds to obtain compensation for the wrongful death of their loved one.
The suspect was charged by Saunders County Attorney Scott Tingelhoff on Tuesday. Sean Salisbury, 22, was charged with manslaughter after unintentionally causing the death of Mickayla Linn. Manslaughter, a felony crime, is punishable by one to 20 years in prison. The boat accident occurred in July boating on Woodcliff Lake. According to Tingelhoff, Salisbury was operating a boat behind which Linn was tubing. Salisbury realized that both the boat and Linn were too close to the docks, so he made a sharp turn toward an island, but the turn caused the tube and Linn to fling toward another vessel that was on a nearby lift. Linn was transported to the Fremont Area Medical Center, where she was pronounced dead.
Witnesses who near the scene of the accident say that Salisbury was boating recklessly. Tingelhoff added that Salisbury had been drinking on the day of the crash, but his blood-alcohol level was found to be within the legal limits.
According to U.S. Coast Guard statistics, “alcohol use is the leading contributing factor in fatal boating accidents” and was listed as the main factor that contributed to 16 percent of boating accident deaths in 2011.
